“COMMUNITY AT HOME” CONTEST RULES

Contest Official Contest Rules – BEST FIENDS COMMUNITY AT HOME

NO PURCHASE NECESSARY, VOID WHERE PROHIBITED.

“BEST FIENDS COMMUNITY AT HOME” (“The Contest”) is an online contest that awards participants for the best videos submitted as judged by set criteria.  For consideration (including, without limitation, the possibility of publicly using your name and participant information), the Participant is submitting certain information via Dropbox, through this link: https://www.dropbox.com/request/LPNtk4n4qZ4tYGGg7BPE  for the benefit of Seriously Digital Entertainment, Inc. and its affiliates, subsidiaries and parent company (either the “Company” or “Seriously”) upon the following terms and conditions.

BEFORE YOU SUBMIT A VIDEO TO ENTER THE CONTEST, READ THE OFFICIAL CONTEST GUIDELINES BELOW. BY SUBMITTING A VIDEO, YOU ARE AGREEING TO BE BOUND BY THESE OFFICIAL GUIDELINES.

BY PARTICIPATING IN THE CONTEST, YOU AGREE TO THE COMPANY’S PRIVACY POLICY AND TERMS OF SERVICE, AVAILABLE ON THE BEST FIENDS WEBSITE AND THE TERMS AND CONDITIONS AVAILABLE IN THIS DOCUMENT, AND THAT YOUR SUBMISSION AND THE INFORMATION INPUT ON THE SUBMISSION APPLICATION FORM WILL BE SHARED WITH THE COMPANY AND THAT YOU MAY BE CONTACTED BY THE COMPANY IN CONNECTION WITH THE CONTEST. YOUR PERSONAL INFORMATION WILL NOT BE USED FOR MARKETING PURPOSES WITHOUT YOUR CONSENT.

ALL DECISIONS, SELECTIONS AND DETERMINATIONS STATED HEREIN TO BE MADE BY THE COMPANY MAY BE MADE ON ITS BEHALF BY ITS DESIGNATED AGENT AND ARE UNDERSTOOD AND AGREED TO BE IN THE COMPANY’S SOLE AND ABSOLUTE DISCRETION. ALL SUCH DECISIONS ARE FINAL.

1. ELEGIBILITY

The Contest is open to Participants worldwide, i.e. person(s) who submit a video which complies with the rules herein, who are legal residents of their countries of residence, and who are 18 years of age or older as of the time of the Video submission. Employees of Seriously, its companies, parent and subsidiaries, as well as agents and representatives of Seriously, its companies and subsidiaries, are not eligible to participate. The Company reserves the right to disqualify any individual and any or all of his/her submission application(s) if he/she is deemed by the Company to be (a) tampering with the entry process or the operation of the Contest; (b) violating the Terms of Service; (c) violating the conditions of use and/or general rules; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or act fraudulently in any manner.

Void where restricted, or prohibited by law.

CONTEST PERIOD

The contest begins on April 13, 2020 at 8am PST and ends April 19, 2020, at 11:59pm PST.  A Seriously judging panel will select all Videos that qualify and meet the judging criteria standards on or about April 23, 2020 at 12pm PST which shall be judged on the below criteria.

2. HOW TO PARTICIPATE

 Video Submission
During the Contest Period, use the following link https://www.dropbox.com/request/LPNtk4n4qZ4tYGGg7BPE and submit your video which answers the following questions about yourself and Best Fiends.

-What is your name?
-What country, state and town are you from?
-What level are you on in Best Fiends?
-How did you first hear about Best Fiends?
-Do any of your family/friends play Best Fiends?  Do not use proper names of others.
-Who is your favorite Fiend and why?
-Why do you love Best Fiends?

Create an original Video that is no longer than 2 minutes which answers the questions set out here and on the Facebook post calling for entries and the “Community at Home Official Rules and Release” webpage. The winning Videos will be cut and edited together episodically along with those of other winners to focus on one or more of the questions and introduced by a Company-selected host.

All Videos become the property of the Company. By submitting a Video, Participant grants to the Company and its designees a non-exclusive, worldwide, royalty-free, perpetual, unrestricted, irrevocable and sublicensable right to re-use in whole or in part, reproduce, modify, edit and redistribute the Video in any form, format or media, individually and together with Videos of other winners and other materials.

By submitting a Video, Participant affirms that he/she is submitting an original Video and has all legal rights to submit the Video

Judging Period

All eligible Videos will be judged by a contest committee using a point-based rubric the top fifty winning Videos will be selected for featuring on the Best Fiends Facebook page and other official Best Fiends social channels. All decisions made by the judges are final and binding and will determine the final winners. Judges will use the following criteria:

– 25%: Adherence to the instructions in the Contest Facebook post and to all of the directions

-25%: Quality of the video you submit (audio, video, etc.)

-25%: Energy and enthusiasm shown towards the content being presented

-25%: Poise and showmanship

The Winners will be notified on or about April 23, 2020 by email.

3. WINNER NOTIFICATION

The contest winners will be notified as set forth above and be required to complete and Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) to the extent not submitted along with the Video and any other documents required by the Company, which must be returned by April 26, 2020. Return of prize or prize notification as undeliverable, failure to sign and return documentation within the specified period, or the inability of the Company to reach the winner within a reasonable amount of time may result in disqualification at the Company’s discretion.

The winners will be announced publicly via the Facebook Fan Page and other official communication channels on or about April 27, 2020.

4. PRIZES AND APPROXIMATE RETAIL VALUES

10 Gold, 50 Keys, and 1,000 Diamonds in Virtual Credits for use in Best Fiends only to be deposited by Company in the winners’ accounts upon verification and upon winner’s providing their Best Fiends Support ID to Seriously or a Seriously representative.  NO CASH VALUE.

An opportunity to have your Video displayed on Company’s Best Fiends Facebook page and in other official social media initiatives of Company which Company may have edited together with other winning Videos and other content to create multiple episodic thematic videos which address one or more of the Contest questions. NO CASH VALUE.

All prizes are non-transferrable.

5. LIMITATIONS ON LIABILITIES

By submitting a video, Participant agrees that:

• Any and all disputes, claims and causes of action arising out of or connected with the submission, the Contest will be resolved individually, without resort to any form of class action;
• Any and all claims, judgments and awards will be limited to actual third-party, out of pocket costs incurred, but in no event will attorney’s fees be award or recoverable;
• Under no circumstances will Participant be permitted to obtain any award for, and Participant knowingly and expressly waives all rights to seek, punitive, incidental, consequential or special damages, lost profits, business opportunity, damage to reputation or goodwill and/or any other similar damages;
• They release and hold harmless Release Parties from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of the Company infringes on the rights of Participant as contained in any application or otherwise.
